1. Acceptance of Terms

By using this website or purchasing services from Hughes Mechanical Design, you agree to these Terms of Service.

2. Services

Services may include:

  • Mechanical design
  • CAD modeling
  • Prototyping
  • Custom manufacturing aids
  • 3D printing
  • Engineering consultation
  • Product development assistance

All services are provided on a best-effort basis and do not constitute licensed engineering approval unless specifically stated.

3. Quotes and Payments

Quotes are estimates and may change if project requirements change.

Payment terms may require:

  • Deposits before work begins
  • Full payment before shipment or file release
  • Additional charges for revisions or scope changes

Prices are subject to change without notice until accepted in writing.

4. Intellectual Property

Customers retain ownership of designs, files, and concepts they provide.

Unless otherwise agreed in writing, Hughes Mechanical Design retains ownership of design methodologies, processes, and internally developed tools.

Upon full payment, deliverables specifically created for the customer become the property of the customer.

We reserve the right to display completed projects for portfolio or marketing purposes unless otherwise agreed in writing or covered by a Non-Disclosure Agreement (NDA).

5. Confidentiality

We make reasonable efforts to maintain confidentiality regarding customer projects. A separate Non-Disclosure Agreement (NDA) may be executed upon request.

6. Prototype Disclaimer

Prototype and 3D printed parts are intended for evaluation, testing, and non-critical applications unless otherwise specified.

Customers are responsible for verifying suitability for their intended use.

7. Manufacturing Tolerances and Variability

Customers acknowledge that:

  • 3D printed and prototype parts may contain minor cosmetic imperfections.
  • Material properties and dimensions may vary within normal manufacturing tolerances.
  • Color, surface finish, and dimensional accuracy may differ slightly from digital models.
  • Hughes Mechanical Design does not guarantee exact duplication of colors, textures, or finishes.

8. Limitation of Liability

To the fullest extent permitted by law, Hughes Mechanical Design shall not be liable for:

  • Lost profits
  • Business interruption
  • Indirect, incidental, special, or consequential damages
  • Failure of prototypes or manufactured components
  • Damages arising from misuse or improper installation
  • Damages caused by modifications made after delivery

Total liability shall not exceed the amount paid for the specific services provided.

9. Customer Responsibility

Customers are responsible for:

  • Providing accurate specifications and dimensions
  • Reviewing and approving designs before production
  • Ensuring compliance with applicable laws and regulations
  • Performing appropriate testing before production or deployment
  • Ensuring products are suitable for their intended application

10. File Ownership and Deliverables

Upon receipt of full payment, customers receive ownership of files and deliverables specifically created for their project unless otherwise agreed in writing.

Native CAD files, source files, and editable design files may require separate purchase or agreement.

11. Shipping and Delivery

Delivery dates are estimates only and are not guaranteed.

Hughes Mechanical Design is not responsible for delays caused by:

  • Shipping carriers
  • Weather events
  • Supply chain interruptions
  • Material shortages
  • Circumstances beyond our control

Risk of loss transfers to the customer upon delivery to the carrier.

12. Refund Policy

Due to the custom nature of engineering design, CAD work, and 3D printing services, refunds are generally not available once work has begun.

Refund requests may be considered on a case-by-case basis at our sole discretion.

Completed design work, consultation services, and custom-manufactured products are non-refundable.

13. Cancellation Policy

Projects may be canceled before work begins.

If work has already started, customers may be responsible for payment for:

  • Time already invested
  • Materials purchased
  • Manufacturing expenses incurred

14. Prohibited Uses

Customers may not use our services for:

  • Illegal purposes
  • Counterfeit products
  • Weapons prohibited by law
  • Products intended to infringe intellectual property rights
  • Unsafe or unlawful applications

We reserve the right to refuse any project at our discretion.

15. No Engineering Certification

Unless explicitly stated in writing, services provided by Hughes Mechanical Design do not constitute licensed engineering certification, professional engineering approval, or stamped drawings.

16. Warranties

Services and products are provided "AS IS" without warranties of any kind, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

No warranty is provided regarding performance, durability, or suitability for any specific application.

17. Indemnification

Customers agree to indemnify and hold harmless Hughes Mechanical Design from any claims, damages, liabilities, losses, expenses, or attorney fees arising from:

  • Use or misuse of products or designs
  • Modification of deliverables
  • Violation of laws or regulations
  • Claims brought by third parties relating to customer projects

18. Force Majeure

Hughes Mechanical Design shall not be liable for delays or failure to perform due to circumstances beyond reasonable control, including:

  • Natural disasters
  • Fire
  • Flood
  • Power outages
  • Labor shortages
  • Material shortages
  • Government actions
  • Transportation interruptions

19. Dispute Resolution

Any dispute arising from these Terms or services provided by Hughes Mechanical Design shall first be attempted to be resolved through good-faith negotiation.

If resolution cannot be reached, disputes shall be governed by the laws of the State of Oklahoma.

Any legal action shall be brought exclusively in the courts located within Oklahoma.

20. Changes to Terms

Hughes Mechanical Design reserves the right to modify these Terms at any time. Updated Terms become effective upon posting to the website.
